These terms apply when you join Circle 001, the founding membership of MICRO by The Fix. Circle 001 is offered by The Fix Collective Ltd, trading as MICRO by The Fix ("MICRO", "we", "us" or "our"), with registered office at 128 Ebury Street, London SW1W 9QQ.
Please read these terms before paying your £275 founding payment. Your acceptance at checkout and payment of £275 create the Circle 001 contract.
1. YOUR CIRCLE 001 MEMBERSHIP
Circle 001 is MICRO’s founding membership and is limited to 60 members. Founding numbers are allocated in the order in which we receive the £275 Advance First Month Membership Fee.
Circle 001 includes 16 classes per Membership Month at all available hours, one 1-hour lymphatic treatment per Membership Month, and 15% off food and beverage at MICRO.
Classes, treatments and other benefits are subject to booking and reasonable operational rules provided before the studio opens. Those rules may deal with booking windows, cancellations, no-shows, safety and studio conduct, but will not change your Founding Rate, reduce the core Circle 001 benefits above, introduce a minimum membership term or materially reduce your rights under these terms without your express agreement.
2. YOUR FOUNDING RATE
Your Circle 001 membership rate is £275 per Membership Month, inclusive of VAT at the rate applicable when you join. The underlying membership fee remains fixed for as long as your Circle 001 membership continues without interruption.
If the applicable VAT rate or another mandatory tax imposed on the membership changes, the amount you pay may change only to reflect that change.
Circle 001 carries no joining fee while your founding membership remains continuous. If you cancel or otherwise end Circle 001 and later rejoin MICRO, the Founding Rate and joining-fee exemption do not revive. Any future membership will be on the prices and terms then available.
3. THE £275 YOU PAY TODAY
The £275 paid when you join is an advance payment of your first Membership Month. It is not a deposit, reservation fee or joining fee. Payment secures your Circle 001 place but does not start the membership services immediately.
4. WHEN YOUR MEMBERSHIP STARTS
Your membership services start on the date the MICRO Chelsea studio opens to members (the "Membership Commencement Date"). We will notify you of that date in writing at least 30 days beforehand.
Until the Membership Commencement Date, no classes, treatments or other membership benefits accrue, no unused allowances arise or carry forward, and no further monthly membership payment is due. Your £275 Advance First Month Membership Fee is applied to month one.
5. SAVED PAYMENT METHOD AND FUTURE MONTHLY CHARGES
If you expressly authorise this at checkout, Stripe will securely save the payment method you use for the £275 founding payment so that MICRO can collect future Circle 001 monthly membership fees without asking you to re-enter your card details each month. MICRO does not store your complete card details.
The saved payment authority is for Circle 001 membership fees only. Subject to any different payment arrangement you later expressly agree, we will charge £275 for your second Membership Month and £275 for each Membership Month after that, on or around the monthly anniversary of the Membership Commencement Date, until your membership or the payment authority ends. No recurring membership charge will be taken before your second Membership Month.
When we notify you of the Membership Commencement Date, we will also confirm the date of the first recurring charge. If the amount payable changes solely because of a change in VAT or another mandatory tax, we will notify you before the first charge at the changed amount.
We will not use the saved-payment authority to charge treatments, food and beverage, retail or other separately priced purchases. Those require a separate payment instruction or consent.
You may cancel the recurring card authority by contacting MICRO or your card issuer. Cancelling that payment authority does not by itself cancel your Circle 001 membership or any amount properly due under it. If your membership is continuing, you must provide another valid payment method or separately cancel the membership under clause 10.
If you later choose an annual-prepayment option or another payment arrangement offered by MICRO, that separate agreement will govern the relevant period and we will not make monthly charges under this authority for a period that has already been prepaid.
6. IF THE OPENING DATE CHANGES
Any opening date communicated before the Membership Commencement Date is confirmed may change. If the opening date changes, your £275 remains credited towards your first Membership Month unless you cancel under clause 7. Your full pre-opening refund right continues until the actual Membership Commencement Date.
7. CANCELLING BEFORE MICRO OPENS
You may cancel Circle 001 at any time before the Membership Commencement Date. If you do, we will refund your £275 in full to the original payment method. No cancellation fee or payment-processing charge will be deducted.
To cancel, email hello@microbythefix.com and tell us clearly that you wish to cancel Circle 001. This contractual right is in addition to your statutory cooling-off rights below.
8. YOUR STATUTORY 14-DAY COOLING-OFF RIGHT
Because you are entering into this membership online, you also have a statutory right to cancel the contract without giving any reason during the 14 days following the day on which the contract is entered into.
You can exercise this right by emailing hello@microbythefix.com, using the model cancellation form provided to you, or otherwise making a clear statement that you wish to cancel.
If you cancel during the statutory cooling-off period and no membership services have been provided, we will refund all amounts paid within 14 days of being informed of your decision to cancel. Nothing in these terms limits your statutory consumer rights.
9. IF MICRO DOES NOT OPEN
If MICRO does not open, we will refund your £275 in full. If we decide not to open the Chelsea studio, we will notify you and refund the £275 to your original payment method within 14 days.
10. MEMBERSHIP AFTER OPENING
Circle 001 has no minimum membership term. Once your membership has started, it continues monthly unless you or we end it in accordance with the applicable membership terms.
You may cancel by giving 30 days written notice. Cancelling the membership ends your entitlement to the Circle 001 Founding Rate and joining-fee exemption; they cannot be reinstated if you later rejoin.
11. PRIVACY AND PAYMENT DATA
We use personal data to administer your application, payment and membership and for the other purposes described in the MICRO Privacy Policy. Where you authorise the payment method to be saved, Stripe securely stores the underlying card details and provides MICRO with the limited payment reference information needed to administer the recurring membership charges. MICRO does not store your complete payment-card details.
12. YOUR LEGAL RIGHTS
Nothing in these terms excludes or restricts any rights you have under applicable consumer law. These terms and your membership contract are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you retain any mandatory rights and rights to bring proceedings available to you where you live.
