These terms apply when you join Circle 001, the founding membership of MICRO by The Fix.
Circle 001 is offered by The Fix Collective Ltd, trading as MICRO by The Fix, a company registered in England and Wales under company number 16829203, with registered office at 128 Ebury Street, London SW1W 9QQ (“MICRO”, “we”, “us”).
Please read these terms before paying your £275 founding payment.
1. Your Circle 001 membership
1.1 Circle 001 is MICRO’s founding membership and is limited to 60 members.
1.2 Your founding number will be allocated in the order in which we receive your Advance First Month Membership Fee.
1.3 Circle 001 includes:
- (a) 16 classes per membership month, at all available hours;
- (b) one 1-hour lymphatic treatment per membership month; and
- (c) 15% off food and beverage at MICRO.
1.4 Classes, treatments and other benefits are subject to booking and reasonable operational rules which we will provide before the studio opens.
1.5 Those rules may deal with matters such as booking windows, cancellations, no-shows, safety and studio conduct, but will not change your Founding Rate, reduce the core Circle 001 benefits set out above, introduce a minimum membership term or materially reduce your rights under these terms without your express agreement.
2. Your Founding Rate
2.1 Your Circle 001 membership rate is £275 per month, inclusive of VAT at the rate applicable when you join.
2.2 The underlying membership fee will remain fixed for as long as your Circle 001 membership continues without interruption.
2.3 If the applicable rate of VAT or another mandatory tax imposed on the membership changes, the amount you pay may change only to reflect that change.
2.4 Circle 001 carries no joining fee while your founding membership remains continuous.
2.5 If you cancel or otherwise end your Circle 001 membership and later choose to rejoin MICRO, your Circle 001 Founding Rate and joining-fee exemption will not carry over. Any future membership will be subject to the prices and terms then available.
3. The £275 you pay today
3.1 The £275 paid when you join is an advance payment of your first month’s Circle 001 membership fee. It is not a deposit, reservation fee or joining fee.
3.2 Payment secures your Circle 001 place. It does not start your membership services immediately.
4. When your membership starts
4.1 Your membership will start on the date the MICRO Chelsea studio opens to members (the Membership Commencement Date).
4.2 We will notify you of the Membership Commencement Date in writing at least 30 days beforehand.
4.3 Until the Membership Commencement Date:
- no classes, treatments or other membership benefits accrue;
- no unused allowances arise or carry forward; and
- no further monthly membership payment is due.
4.4 Your £275 Advance First Month Membership Fee will be applied to your first membership month.
4.5 We will contact you before the Membership Commencement Date to arrange the payment method for future membership fees.
4.6 Your next monthly membership fee will not become due until your second membership month.
5. If the opening date changes
5.1 Any opening date communicated before the Membership Commencement Date is confirmed may change.
5.2 If the opening date changes, your £275 will remain credited towards your first membership month unless you choose to cancel under clause 6.
5.3 Your right to cancel and receive a full pre-opening refund continues until the Membership Commencement Date.
6. Cancelling before MICRO opens
6.1 You may cancel your Circle 001 membership at any time before the Membership Commencement Date.
6.2 If you do, we will refund your £275 in full to your original payment method. No cancellation fee or payment-processing charge will be deducted.
6.3 To cancel, email hello@microbythefix.com and tell us clearly that you wish to cancel your Circle 001 membership.
6.4 This contractual cancellation right is in addition to your statutory cooling-off rights described in clause 7.
7. Your statutory 14-day cooling-off right
7.1 Because you are entering into this membership online, you also have a statutory right to cancel your contract without giving any reason during the 14 days following the day on which the contract is entered into.
7.2 You can exercise this right by emailing hello@microbythefix.com, using the model cancellation form provided to you, or otherwise making a clear statement that you wish to cancel.
7.3 If you cancel during the statutory cooling-off period and no membership services have been provided, we will refund all amounts paid by you within 14 days of being informed of your decision to cancel.
7.4 If, at your express request, membership services begin during the statutory cooling-off period, the legal rules relating to payment for services supplied before cancellation will apply.
7.5 Nothing in these terms limits your statutory consumer rights.
8. If MICRO does not open
If MICRO does not open, we will refund your £275 in full.
If we decide not to open the Chelsea studio, we will notify you and refund the £275 to your original payment method within 14 days.
9. Membership after opening
9.1 Circle 001 does not have a minimum membership term.
9.2 Once your membership has started, it will continue on a monthly basis unless you or we end it in accordance with the applicable membership terms.
9.3 You may cancel by giving us 30 days’ written notice.
9.4 Cancelling your membership ends your entitlement to the Circle 001 Founding Rate and the Circle 001 joining-fee exemption. They cannot be reinstated if you later rejoin.
10. Your personal data
10.1 We use your personal data to administer your application, payment and membership and for the other purposes described in our Privacy Policy, available through the link provided before you complete your purchase.
10.2 Payment-card information is processed securely by our payment provider. MICRO does not store your complete payment-card details.
11. Your legal rights
11.1 Nothing in these terms excludes or restricts any rights you have under applicable consumer law.
11.2 These terms and your membership contract are governed by the laws of England and Wales. If you live elsewhere in the United Kingdom, you retain any mandatory rights and rights to bring proceedings available to you where you live.
